加拿大食品检验局(CFIA)对1983年《饲料条例》提出的修正案已在加拿大公报,第一部分(CG I)上预先公布,从2021年6月12日至10月15日进行125天的公众咨询。咨询的目的是收集与加拿大牲畜饲料相关的利益相关者对进口、出口和生产法规拟议变化的反馈。

The proposed requirements for feed imports highlights:
-All imported single ingredient feeds and mixed feeds must be registered or imported by a licence holder.
-All imported feeds must meet Canadian standards and labelling requirements.
-Imported feeds must indicate on the label where they were manufactured or who they are imported by or for.
-The importer of the feed must be able to demonstrate that the feed was manufactured under conditions that provide at least the same level of protection as if it was made in Canada

Here is a summary report that outlines what was heard from the public, academia, organizations or individuals, and other government departments.

Amendments to the Feeds Regulations, 1983 are scheduled to be published in the Canada Gazette, Part II (CG II) in 2023.

马来西亚成为第9个批准并加入《全面与进步跨太平洋伙伴关系协定》(CPTPP)的国家。CPTPP协议是加拿大和其他10个亚太国家签订的:澳大利亚、文莱、智利、日本、马来西亚、墨西哥、新西兰、秘鲁、新加坡和越南。其余CPTPP加入国的关税取消信息是文莱和智利,一旦这些国家批准该协议,就可以获得。

As of November 29th, 2022, eligible goods from Malaysia benefit duty reductions under CPTPP preferential treatment.  Canada Border Services Agency (CBSA) has published Customs Notice CN22-22 to inform industry of the changes.

The list of countries in the Customs Tariff T2022-5 has been updated to include the CPTPP tariff treatment for Malaysia. This tariff treatment is the Comprehensive and Progressive Trans-Pacific Partnership Tariff (CPTPT) – Code 33.

The Department of the Environment is seeking your comments on proposed administrative amendments that will ensure Wild Animal and Plant Trade Regulations (WAPTR) remains aligned with the purposes set out in the Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act (WAPPRIITA) and decisions adopted by various Conferences of the Parties (CoP) to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).

The comment period is open from October 29 to December 28, 2022

Canada’s domestic implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) is through WAPTR. Since the implementation of the Regulations in 1996, Schedule I has been amended many times to reflect changes to the list of protected species under the Appendices of CITES made by the Conference of the Parties (CoP) to CITES, which takes place approximately every two to three years. However, other decisions related to guiding the implementation of CITES have not been incorporated into the Regulations.

The primary objectives of the proposed amendments are to ensure WAPTR remain aligned with the purposes set out in the Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act (WAPPRIITA) in relation to decisions adopted by CITES CoPs. The proposed amendments will also address enforceability issues, update the structure of the Regulations to better reflect current drafting practices, modernize the language, address inconsistencies, and finally reduce the administrative burden where possible.

The CBSA advised on December 2, 2022, that it has concluded the expedited review of certain goods oil country tubular goods subject to the oil country tubular goods SIMA case, exported to Canada from China by Golden Ring Industrial Limited (Golden Ring).

As a result of the investigation, normal values have been issued to Golden Ring. Imports of subject goods from this exporter which have been sold to Canada at or above the normal values issued will not be subject to anti-dumping duties.

As a result of the reviews, the CBSA has issued normal values for the Shandong Continental and CPTDC. As such, anti-dumping duties will not be payable on imports of goods subject to these reviews, provided that they are sold to Canada at or above the normal values issued by CBSA.

The Canada Border Services Agency (CBSA), on December 2, 2022, concluded a normal value review to determine normal values and export prices of certain carbon steel fasteners subject to the Fasteners SIMA case, exported to Canada from Taiwan by Jwu Sheng Enterprise Co.

As a result of the review, the CBSA has determined that the information provided by Jwu Sheng was not provided or was insufficient. As such, normal values were not issued, and the anti-dumping rate applicable to subject goods imported from this exporter will be the “all other exporters” rate of 170%.

一次性塑料禁止条例(SUPPR)将于2022年12月20日生效。新规定禁止将结账袋、餐具、餐饮用具、搅拌棒和吸管进口加拿大。

The Canada Border Services Agency (CBSA) has provided the following advisory on the administration of this prohibition:

“At it’s inception the plastics ban will not be a Customs Tariff Ban. Our prohibited importations unit have advised that this is something that ECCC will be enforcing away from the border for a short time with a possibility of being incorporated into border enforcement afterwards. As there will be no changes to the Customs tariff, nor will this be enforced by the CBSA, our area will not be publishing a customs notice.”

The ECCC Plastics Division will be enforcing the new regulations and advises on how this would be managed away from the border: the following message was provided:

“The Regulations prohibit the manufacture, import and sale of single-use plastic (SUP) checkout bags, cutlery, foodservice ware made from or containing problematic plastics, ring carriers, stir sticks, and straws, with some exceptions for SUP flexible straws.

Verification of compliance with the Single-use Plastics Prohibition Regulations is carried out by Environment and Climate Change Canada enforcement officers who act in accordance with the Compliance and Enforcement Policy for the Canadian Environmental Protection Act, 1999. Verification of compliance with the Regulations could include site visits, review of records, product testing (if applicable), and review of written transit documents.”
